CLIENT AGREEMENT




USEAGE & PERMISSIONS:


▶ Work is created for personal use only.

▶ Work may not be re-sold in whole or part as physical objects or downloadable files. Files cannot be redistributed for free. Sales of the work in the form of merchandise are possible but an additional fee must be agreed upon and paid. This fee will vary depending on the scope or expected sales of the commercial venture.

▶ No images can be created into NFTs under any circumstance

▶ Artwork may be used for self-promotion: Merchandise may be created for personal use or for giveaways for promotion (ie. shirts, mugs, stickers, etc)

▶ If posted via social media etc. work must be credited properly. The client cannot take credit for the work.

▶ work may not be traced or edited without permission


COPYRIGHT


▶ If the client provides any elements to the designer for the project, the client is consenting that they have the proper copyright privileges to use the elements provided.

▶ If elements provided by the client to the designer are not within the legal rights to use by the client, the designer assumes no responsibility for legal issues arising from the use of these elements in the work produced.

▶ This excludes refrence images


DEPOSITS & PRICES:


▶ Prices are set for individuals or small businesses only. Work may not be used for a corporate business unless otherwise agreed upon.

▶A deposit amounting to no less than 50% of the total estimated cost will be paid before the project is started: either production or consultation. This deposit is non-refundable.

▶ Payment of the remaining balance is to be made upon completion of the project. Permission to use work in part or whole will only be granted upon full payment.

▶ If the project is abandoned without proper payment it may be re-sold to recoup lost time with or without changes.


PROMOTION:


▶ The work will be used by the designer to promote their business via social media and in their portfolio. The client will be cited where appropriate.


FEEDBACK


▶ Any feedback or revisions given by the client must be documented via email (not social media, DMs, or Discord etc.).


CORRECTIONS:


▶ Minor changes are free, but once sketches or finish art are approved by the client, an hourly charge will apply to make further changes or corrections.

▶ The designer will proof the project to make sure every aspect is correct, however, it is the responsibility of the client to make sure the proof is 100% error-free when it is approved.

▶ If errors are found after a project has been completed, the client will be charged for additional revisions to change these errors.


BREAKING THE AGREEMENT


▶ If the client is found breaking any part of the agreement, permission to use the work will be retracted without refund.
